A High Court of Justice sitting at Gumel presided by Justice M. A Sambo on Wednesday found one Habibu Haruna of Dan Makama Village in Suletankarkar Local Government guilty of culpable homicide punishable with death under section 221 (b) of the Penal Code Law.
According to medical report, the convict had used a hoe and stick to strike one Aisha Adamu (now deceased) on her forehead, which resulted in her death.

In proving the case, the prosecution called two witnesses and tendered confessional statements that were admitted in evidence, and the convict testified in his defence.
Having satisfied that the Prosecution had proven its case beyond a reasonable doubt, the court convicted Haruna and sentenced him to death by hanging.
Delivering another judgment Justice M. A Sambo discharged and acquitted a father and son – Mohammed Sani and Yahaya Sani – accused of Criminal Conspiracy and culpable homicide contrary to sections 96 and 221 of the Jigawa panel code.
The facts of the case were that one Saleh Ado, a lunatic of Zuge Village in Gumel Local Government Area, sneaked into the house of the defendants with a stick and knife and attacked the father, while the son, in an effort to protect his father, used an axe to hack the Ado death.
The prosecution called eight witnesses and tendered confessional statements and medical evidence, while the defence called only the second defendant and closed the case. The Court discharged and acquitted the defendants on the ground of self-defence.
In another development, a High Court in Birnin Kudu on Wednesday convicted one Boniface Afifa Oru and Prof. Steve Uchella on three count charges of Criminal Conspiracy, Criminal Breach of Trust and Forgery.
The defendants were arraigned on the 21st March 2018 before the court and pleaded not guilty of all the three counts charges. In prove of the case, the Prosecution called seven witnesses and close their case. The defendants testified on their behalf.
The Judge held that the prosecution has proved their case beyond reasonable doubt thereby found the defendants guilty of the offences and sentenced them as follows:
For the offence of Conspiracy they were convicted to 3 months imprisonment or a fine of 30,000 each.. For Criminal Conspiracy and Breach of trust, awards them with 5years jail term or a fine of 500,000 Naira each.
In a different case, on 16th August, 2021, the Chief Judge of Jigawa State Hon. Justice Umar M. Sadiq had discharged and acquitted one Abdussalam Ado of Gabarin Village in Ringim Local Government Area over the allegation of rape.
According to CJ, the confessional statement given by the defendant was not voluntary, and it was rejected.
The Chief Judge concluded that the Prosecution had failed to prove the case against the defendant beyond a reasonable doubt, therefore discharged and acquitted the defendant.
