Who pays when AI fails?

As of today, whether people agree or not, artificial intelligence has come to stay. It is no longer a distant or experimental technology. AI systems already shape decisions in governance, finance, security, healthcare, education, and public administration. When they work, the benefits are celebrated. When they fail, the consequences are real and often costly.

As a Fellow of AI Policy and Governance under the OpenSchool Initiative, in collaboration with other prominent organizations, I have spent the past three months engaging with leading scholars and practitioners in artificial intelligence and public policy across the globe. This exposure has significantly expanded my understanding of the AI revolution, not just in terms of innovation and opportunity, but more importantly in terms of its consequences.

Most AI conversations focus on efficiency, scale, disruption, and competitive advantage. Today, I want to deviate deliberately from that dominant narrative to ask a harder and less comfortable question, one that goes to the heart of governance and professional ethics: who pays when AI fails?

AI failures are rarely technical curiosities. They often translate into flawed policy decisions, financial losses, discrimination, reputational damage, or harm to citizens who had no say in the systems affecting them.

Recent global experiences show a recurring pattern. Large organizations have faced scrutiny over data-driven tools and algorithmically informed models that later raised concerns about bias, flawed assumptions, or unintended downstream effects. In the public sector, rapid digitization efforts in several countries have triggered debates around automated decision-making, transparency, and institutional readiness.

In each case, the most revealing issue was not simply that AI systems underperformed or misfired. It was what happened after. Responsibility became blurred. Accountability became negotiable.

When AI systems fail, responsibility often circulates without settling anywhere.

1. Developers point to imperfect data.

2. Organizations blame the tool rather than the decision to deploy it.

3. Professionals defer to automation.

4. Institutions cite innovation pressure and global competition.

The result is an accountability vacuum. Everyone was involved. No one is clearly responsible.

This diffusion of responsibility is not accidental. It is structurally convenient. AI allows institutions and professionals to hide behind complexity, opacity, and technical jargon. “The system decided” becomes a convenient shield.

But convenience is not ethics, and complexity does not erase responsibility.

One of the most dangerous misconceptions in AI adoption is the belief that automation reduces professional responsibility. In reality, it increases it.

Every AI system reflects human choices: what data to use, what outcomes to optimize for, what risks to tolerate, and where to deploy it. Professionals who rely on AI outputs without understanding their limitations are not being neutral. They are being negligent.

AI should augment human judgment, not replace it. Delegation without oversight is not innovation. It is abdication.

As AI becomes embedded in professional practice, new duties emerge: a duty to understand system limitations, a duty to supervise automated outputs, a duty to disclose AI involvement in consequential decisions, and a duty to anticipate and mitigate foreseeable harm.

So, who should pay?

When AI fails, accountability should be shared but traceable.

1. Organizations must answer for deployment decisions and governance failures.

2. Professionals must answer for uncritical reliance on automated outputs.

3. Developers must answer for foreseeable risks and design choices.

4. Regulators must answer for oversight gaps and delayed frameworks.

Not everyone pays equally, but someone must pay clearly. Without consequence, AI governance becomes performance rather than protection.

AI systems will fail. That much is inevitable. No technology is infallible. What remains optional is whether responsibility fails alongside it.

If professionals and institutions do not define accountability now, it will be defined later through litigation, public backlash, regulatory overcorrection, and loss of trust. History shows that professions that fail to self-regulate during technological transitions rarely like the solutions imposed from outside.

The age of AI does not abolish accountability. It exposes who was prepared to carry it.
